TERMS OF SERVICE

By placing an order with Whispering Roses (ABN 70 160 024 231), you agree to the following terms:

  • All orders are pre-order only and subject to availability. We limit daily orders to ensure quality.
  • A minimum processing time of 3 days applies to all orders.
  • Customers must provide accurate personalisation details at the time of ordering. Whispering Roses accepts no responsibility for errors resulting from incorrect information provided by the customer.
  • Prices are listed in Australian Dollars (AUD) and are subject to change without notice.
  • We reserve the right to cancel any order and provide a full refund at our discretion.

  • Whispering Roses reserves the right to substitute products or floral varieties based on seasonal availability. In the event a substitution is necessary, we will ensure the replacement is of equal or greater value and maintains the same style, colour palette, and quality standard as the original order. We will make every effort to notify you of any significant changes prior to fulfilment.

 

  • Limitation of Liability

    To the fullest extent permitted by Australian Consumer Law, Whispering Roses shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of our website, reliance on information displayed on our website, or any errors or omissions in product descriptions, pricing, or availability. We reserve the right to correct any errors or inaccuracies at any time without prior notice.

    Australian Consumer Law

    Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

    To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, Whispering Roses limits its liability for any loss or damage arising from our products or services to, at our option: the replacement or re-supply of the product or service, or the cost of having the product or service replaced or re-supplied.

     

    Delivery

    While we make every effort to meet estimated delivery timeframes, Whispering Roses shall not be held liable for delays caused by circumstances beyond our reasonable control, including but not limited to courier delays, extreme weather events, or incorrect delivery details provided by the customer. All arrangements have a minimum 3 business day lead time. Delivery dates selected at checkout are estimates only and are not guaranteed.
